On May 30th 2023, the Chilean Internal Revenue Service (SII), through Ex. Res. No. 63, extended the term for partnerships that can qualify as professional partnerships to register as such with the SII.
The original term, established in Re. Ex. 115 of 2022, to carry out this procedure was June 30th, 2023 and with this new extension, it was set for December 31st, 2023.
It is important to keep in mind that the mere incorporation into the Registry does not convert a company into a professional society, since the SII reserves the necessary control powers to determine that the requirements established in Circular No. 50 of 2022 are met, which are:
• That it be a society of people.
• Its exclusive purpose must be the provision of professional services or advice.
• The services must be provided by the partners, associates or dependents of the company.
• All its partners must exercise their professions for the company, it is not acceptable that one or more of them contribute only capital.
• The professions of the partners must be identical, similar, related or complementary.
